Environment

From wind farms to climate change, the environmental law landscape is ever-changing these days. The application of environment law to property transactions seems to increase in complexity each year, as the full impact of our actions on the environment becomes more evident. Potential environment law liability has become one of the central issues in property and company acquisitions and disposals.

We are fully up to date with all the developments in this complex area of law and advise on the potential impact environment law legislation might have on the acquisition or development of a property. Our Environment Law team advises public and private sector clients including local planning authorities, national and multi-national companies and property developers

Whether you are buying, selling or leasing property, you can't avoid environmental law. We will advise you on how to deal with any environment law liabilities and how to protect your position. Our team will assess the legal risks for you, whether you are an owner, a developer or an occupier and make sure that you understand those risks early on.

As well as the emergence of wind farms in recent years, we have seen the introduction of the regime for the remediation of contaminated land, an overhaul of the integrated pollution prevention and control legislation regulating production industries, the introduction of the climate change levy and changes to the regulation of waste disposal.

If you're buying a business, a company or simply running your own business, you will need to know whether there are any environment licences or consents required. We can provide you with the practical expert advice that you need and can also help in having them transferred. We work with clients in making applications for licences and consents and also help negotiate the legal issues with the regulators.

We are proud of our knowledge of exemptions and can give you the guidance you need to help you work out whether these apply if you are cleaning up contaminated land. Issues relating to contaminated land can often cause problems in transactions but we can help you through the legal liability maze and develop the best course of action for negating these issues.

Environment law is a rapidly developing area and we can provide relevant advice as to the way in which this legislation impacts upon your businesses. We will add value to your deal and make sure that the right frameworks are in place so that you can sell on or lease with confidence.
