Overview:
Lucinda is a partner in our Cambridge Property Litigation team, specialising in Contentious Trust and Probate matters.
Experience:
Lucinda specialises in contentious trust and probate litigation. She is experienced in dealing with applications contesting the validity of wills, applications to remove Executors, claims under the Inheritance (Provision for Family and Dependants) Act 1975 and breach of trust claims.
Lucinda also advises in relation to all types of claims relating to land such as private nuisance claims, commercial landlord and tenant possession proceedings, right of way disputes and boundary disputes.
Background:
Lucinda read law at the University of Exeter before completing her Legal Practice Course in Nottingham. Lucinda trained with the firm, qualifying into the Property Litigation Team in September 2004. She is an Associate Member of the Association of Contentious Trusts and Probate Specialists (ACTAPS) and also a member of the Property Litigation Association.
Additional Information:
Lawrencev Shields v Fen Tigers and Others [2011] EWHC 360 (QB) –Lucinda successfully defended claims in noise nuisance brought against the owners of land on which a Stadium and Racetrack used for motor sports were situated.
Devas v Mackay [2009]EWHC 1951 (Ch) – Lucinda acted for the family of a wealthy widow, Mrs Catherine Devas, who executed a homemade Will which disinherited her family and left the entire estate to the son of one of her carers. The Will was overturned in the High Court. The Judge found that Mrs Devas had lacked testamentary capacity as at the date she executed the Will and did not know and approve of its contents.
