Intellectual property litigation
Even with good intellectual property management, disputes can still arise. Indeed in the case of some of our major clients, success breeds them. Famous brands attract pirates eager to make money by selling cheap copies, causing untold damage to the brand. Hewitsons acts for national and international names on infringement matters involving the full range of intellectual property, particularly patents, copyright design right and trade marks.
We work with clients on strategies involving trading standards and customs resources, solutions for eBay and similar infringements, cease and desist letters and, where necessary, legal action to protect the intellectual property.
We are proud of our record, not only in turning a profit for our clients from this type of infringement by recovering damages in excess of our costs.
When litigation does happen we have extensive experience in dealing with the whole range of intellectual property disputes, both at first instance and on appeal. We recognise the need not only to manage and plan the legal aspects of a claim or defence, but also to appreciate that clients' commercial requirements dictate the need for regular and thorough analysis of costs issues and the ability to respond to commercial imperatives, which often change during a case.
