    Out-Of-Date Assessments Of Development Plan Policies Can Be Site Specific

    The presumption in favour of sustainable development can apply when the development plan policies which are most important for determining the application are out-of-date (per paragraph 11(d) NPPF). The recent case of Ewans v Mid Suffolk District Council [2020] has confirmed that such ‘out-of-date’ assessment of a policy can be site specific.

    Forged Will Dispute Ongoing 14 Years After Death

    In a recent appeal, a probate claim has been returned to the High Court to reconsider whether a purported Will was a forgery. The case may well result in new guidance for courts dealing with potentially forged Wills and shines an interesting light on appealing judgments made during the pandemic generally.
