We advise and assist on all types of agricultural tenancies providing support for landowners throughout the life of a tenancy. We know how tenancies can be at the heart of a rural business, whether for the Landlord or the Tenant, and can provide opportunity as well as valuable income.
We provide specialist advice on Agricultural Holdings Act Tenancies assisting with questions covering issues such as rent review, tenant security, succession and notices to quit. We also advise on surrender and re-grant which may afford the Landlord valuable Agricultural Property Relief from Inheritance Tax. We are often called upon to assist with regaining possession of land to unlock development potential as part of structuring a development sale.
We prepare Farm Business Tenancies and advise on matter arising from lettings of farm land and buildings including breaches of covenant, rent review and termination.
We also deal with commercial lettings of farm buildings to non-agricultural tenants including preparing and negotiating tenancy agreements and where necessary precedent documents for use on farm.
We are involved in ongoing lettings for our clients including preparing residential tenancies as and when the need arises and also preparing proforma documents for use by the landowner him or herself. Lettings to third parties are mostly assured shorthold tenancies but we also advise on protected tenancies for farm workers including preparing tenancy agreements, often on retirement. We can also assist in ensuring that farm workers do not obtain unintended protection under the law and assist with notices to quit.
