TUPE - The Transfer of Undertakings (Protection of Employment) Regulations 2006

Employment law is designed primarily to protect employees, and TUPE is no exception.

Although the principles of TUPE may appear to be relatively straightforward, how it operates to protect employees in practice is complex, reflecting many years of statutory developments and constantly changing case law. Our employment lawyers however are experts in this field.

Often working alongside their corporate colleagues handling the particular corporate transactions, our lawyers help clients through all stages of the information and consultation processes (including supplying paperwork such as letters to employees, ballot papers and so on), drafting and reviewing employment indemnities and warranties contained in the “deal document” and guiding clients through the “measures” and other information and disclosure processes.

They also advise on how to deal with issues such as redundancies and other types of reorganisations connected with the deal, whether taking place before (and often as part of) the completion of the deal, or afterwards.

Whether you are selling or buying a business, or dealing with a contracting in or out of services, our employment lawyers are highly trained and experienced in advising their clients not only on the legal processes which need to be followed, but also the practical steps and issues.

"Valerie was absolutely fantastic in her legal strategy & planning & response times with opposing counsel which was the Chairman of the other firm. When this Chairman was not responsive on many occasions - Valerie kept her cool and responded back in an extremely cool & logical manner. I could not have asked for better counsel in my situation as she reacted extremely well in my case against an opposing legal entity that represented a very large Italian EPC company. This case was settled quickly and amicably by her"
