Benefit Design

The operation of occupational pension schemes involves a complex mix of case, law, legislation, revenue practice and regulatory requirements. We work with employers and trustees to provide proactive and practical advice that is accessible and affordable across the full range of pension issues. This includes:

  • consolidating and drafting of scheme documentation, including trust deeds and rules, booklets and communications
  • advising on the interpretation of scheme rules and legislation, including in relation to Scheme funding and investments
  • advising on the exercise of discretionary powers
  • advising on and the drafting of scheme amendments, including in relation to risk reduction and risk transfer and as a result of mergers, acquisitions and disposals
  • advising on pension flexibilities and the transfer process
  • appointing and removing trustees and advising on the member nominated trustees and member nominated directors regime
  • advising and assisting with pension disputes
  • advising on the implications in the event of marriage breakdown
